Anti-dowry act controversy

Those feminist-hating men (of the Save India Family Foundation) are going to have a field day with this one: Renuka Chowdhury wants to make the already-abused anti-dowry act even harsher.

If the proposal goes through, the stiff anti-dowry laws, which seek to protect brides against greedy husbands and in-laws, will extend the current seven-year window for registration of a “dowry death” case to lifetime — this means that an offence against the husband or in-laws can be made out at any point during married life.

The Women and Child Development Ministry is examining the recommendations of the National Commission for Women and is of the view that given a “rising trend of dowry cases”, there is need for stricter provisions and longer jail terms.

I don’t deny that this law has been misused against men, but think of how many more women have been harrassed and abused for dowry. I am not a lawyer and don’t know what the answer is in terms of writing a better law, but surely some law needs to be in place to protect these women. Given the state of the legal apparatus here, though, this is a tricky situation.

    I don’t know whether making the laws stricter is the answer. The current law is quite strict but it has not been able to prevent the crime. In fact, it is quite rampant. Punishment as deterrent just does not seem to work, particularly in the case of women’s issues. So, I am not so sure this is the right way to go.

    Making a law is easier implementing it in a biased society. We always discuss the deterrent effect of law, what about its preventive and Retributive effect. The only problem with 498A is that it permits the arrest of in –laws including female member of the family. I think that initial arrests should only be limited to the male member of family.

    In article it’s written that “Enter section 498A of the Indian Penal Code. A woman files an FIR. The man goes to jail. There is no bail “. I think it should be like “if a wife files complain that her husband is treating her inhumanly and she is fearful for her life. The person is arrested to protect the woman from any immediate harm”

    What will be effective? Awareness, education, grass root movement, etc. Enacting a law is the most basic step but that does guarantee that it won’t be broken and that it would be reported.
